Terms of service.

These terms are an agreement between you and Go Penguin Solutions LLC ("we", "us"), the operator of Findor. By creating an account or using Findor you accept these terms. If you do not agree, do not use the service.

1. The service

Findor helps you discover public business listings, organize leads, and submit customer-approved messages through a customer-owned SMTP account. Results may be incomplete or unavailable. No buying intent, contact accuracy, reply, delivery, or revenue result is guaranteed. Findor is not affiliated with Google. You are the sole sender of any message; Findor does not run campaigns, sequences, or automatic sending on your behalf.

2. Accounts and your responsibilities

You must be at least 18 years old and authorized to use the sending account and business information you provide. Verify contact information, the lawful basis for outreach, provider permissions, truthful message content, and required disclosures. Do not send prohibited messages or bypass suppression, quotas, or access controls. Keep your credentials secure and your account information accurate.

3. Subscriptions and billing

Findor costs $19 USD per month. Your subscription renews automatically each month at the then-current price until you cancel. The allowance is 100 searches per UTC calendar month, including failed searches, and up to 20 prospect message submissions per UTC day, subject to lower provider limits. Prices exclude tax; if tax is required, it is shown before you are charged. Payments, invoices, and receipts are handled through Stripe. We will email you at least 30 days before any price change takes effect.

4. Cancellation and renewals

Cancel anytime in the Stripe billing portal - the link is in Account settings and in every receipt. Cancelling stops all future renewals; your plan stays active until the end of the period you already paid. Prefer email? Send any message to [email protected] and that is enough - we cancel, no questions asked.

5. 30-day money-back guarantee

30-day money-back guarantee, no questions asked: if you are not satisfied, email [email protected] within 30 days of your first payment and we refund it in full to your original payment method, typically within 5-10 business days. Cancelling stops all future renewals.

6. Sending, monitoring, and opt-outs

SMTP acceptance is not delivery: your provider's rules and reputation govern what happens after submission. It remains your responsibility to monitor your mailbox and provider for replies, bounces, complaints, and sending restrictions; this release does not automatically monitor incoming mail. Findor adds a commercial-message disclosure and an unsubscribe link to reviewed drafts and honors unsubscribe requests on its side, but those controls do not automatically make every message lawful. Suppression records may be kept as needed to honor opt-outs.

7. Your data and our intellectual property

You keep ownership of your account data, leads, notes, and message content. We own the Findor software, design, and documentation. You grant us the limited rights needed to operate the service for you. Lead exports are available in Your leads.

8. Third-party services

Findor depends on third parties including Oracle Cloud hosting, Cloudflare connectivity, Stripe billing, public listing sources (Google Maps observations), your platform email provider, and your own email provider. Their availability and terms are outside our control and may change in ways that affect the service.

9. Disclaimers

Results are dated observations of public listings, limited by returned search depth and matching accuracy, and contact details come from public sources that may be wrong or outdated. Nothing here is legal advice; compliance with outreach laws (including CAN-SPAM) is your responsibility. The service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. Nothing here excludes warranties or rights that cannot be excluded under applicable law.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the six months before the event giving rise to the claim, or (b) $50 USD. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Nothing limits liability for gross negligence, willful misconduct, or fraud, or any liability that Georgia law does not allow to be limited.

11. Indemnity

You agree to indemnify us against third-party claims arising from your outreach, your recipient lists, or your misuse of the service or violation of these terms, to the extent permitted by law.

12. Termination

You may stop using Findor and cancel at any time. We may suspend or end your access if you materially violate these terms (including sending prohibited messages), if the law requires it, or if we discontinue the service. Where practical, we will give notice and an opportunity to export your data. Billing, disclaimers, liability, and dispute sections survive termination.

13. Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Except for claims that may be brought in small-claims court, disputes will be resolved by binding individual arbitration under the rules of the American Arbitration Association, seated in Gwinnett County, Georgia. To the extent permitted by law, you and we each waive trial by jury and the right to participate in a class action. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these terms. Either party may seek injunctive relief in the state or federal courts located in Gwinnett County, Georgia, to protect its intellectual property or the security of the service.

14. Changes and notices

We may update these terms; material changes will be emailed to the address on your account at least 30 days before they take effect. Continued use after the effective date means you accept the updated terms.
